On Wednesday, The Justice Centre for Constitutional Freedoms issued their final legal warning letter to Premier Doug Ford’s government over the oppressive implementation of vaccine passports in Ontario.
In their letter, the Justice Centre notes their “deep concerns” regarding the constitutionality of the vaccine passports system and demands that it be rescinded immediately if the government wishes to avoid legal action.
According to the Justice Centre, they are representing four individuals who are demanding that the passports and mandates be revoked immediately, but that they have received hundreds of complaints from Ontarians.
“Vaccine passports are lauded as an effective tool to prevent [the] spread of COVID-19 and keep Ontarians safe, disregarding the dearth of evidence suggesting current vaccines do not prevent individuals from catching or transmitting the virus,” reads the letter.
“Further,” the letter continues, “no provision is made in the new law for the existence of natural immunity among those with prior exposure to COVID-19. Several studies now indicate that natural immunity to the virus is superior and longer lasting than vaccine-induced immunity.”
“Thus, the new law appears to be about coercing Canadians into taking the vaccine by restricting their freedoms, not about creating virus-free spaces.”
Specifically, the Justice Centre claims that these measures likely violate sections 2, 7, and 15 of the Canadian Charter of Rights and Freedoms, which guarantees the right to freedom of conscience, the right to liberty and security of the person, and the right to be equal before the law.
The Justice Centre also cites a lack of data, pointing out that COVID mRNA vaccines are new and clinical trials will not be complete until 2023. Thus, they argue that having access to all the available data, including long-term studies, is necessary to meet the threshold for informed consent, which may not have been reached legally at this time.
Additionally, the few exemptions to the experimental jabs exclude many justifiable reasons included in the Charter, such as an exemption for religious regions.
Overall, the Justice Centre says they are appalled by the vaccine passport system, calling it blatantly discriminatory and segregationist.
“The new mandate will have the effect of segregating individuals and especially young children from mainstream society. Mandating a system that denies Canadian’s access to certain services that are arbitrarily defined as nonessential by the government creates a slippery slope, and sets a dangerous descent into a medical dictatorship,” notes Justice Centre staff lawyer Henna Parmar.
“If we do not put an end to these measures, we will be putting unlimited power in the hands of the government to dictate what medical care we receive, what drugs we take, and what privileges they will allow us that should be fundamental rights,” added Parmar.
